General Terms and Conditions (GTC) of the AVALES AG Webshop

1. Scope of Application
1.1 These General Terms and Conditions (GTC) govern all orders and bookings made by private customers (“Customers”) via the AVALES Coaching Online Shop.
1.2 The GTC apply exclusively to coaching services booked via the online shop and conducted exclusively in a virtual format.
1.3 For corporate clients, the separate B2B GTC of AVALES AG apply.
1.4 Bookings are only permitted for persons of legal age (18 years and older) with full legal capacity.
1.5 The version of these GTC valid at the time of booking shall be authoritative in each case.
2. Offer and Conclusion of Contract
2.1 The coaching services presented in the online shop do not constitute a legally binding offer, but rather a non-binding invitation to book.
2.2 By completing the order process (checkout), the Customer submits a binding purchase offer.
2.3 The contract is concluded upon receipt of the automated booking confirmation.
2.4 AVALES AG reserves the right to reject bookings without stating reasons, e.g., in the event of lack of availability or obvious misinformation.
3. Services
3.1 The following services can be booked via the online shop:
- Board & Executive Coaching
- Leadership Coaching
- Case Coaching
- Onboarding Coaching
- Career Coaching
3.2 All coaching sessions take place exclusively via video telephony (Microsoft Teams).
3.3 The following options can be selected via the online shop:
- Coaching service (see 3.1)
- Package size (3, 6, 9, or 12 sessions)
- Preferred coach
3.4 Appointments are scheduled directly between the Customer and the coach once the booking has been paid in full.
3.5 After completing the booking, the Customer will receive a personal booking link for the selected coach via email. This link allows the first session to be scheduled directly online and reserved in the coach’s calendar.
3.6 A change of coach is generally possible, provided that:
- another coach is available,
- the coaching can be continued in a professionally sensible manner.
However, there is no fundamental right to a change of coach. Already paid packages remain valid without change in the event of a coach switch.
3.7 If coaching cannot be carried out permanently by AVALES AG or the assigned coach (e.g., due to illness or departure), the following applies:
- AVALES AG will offer an equivalent replacement coach.
- If no replacement coach is available, AVALES AG will refund the sessions not yet consumed on a pro-rata basis.
4. Prices and Payment
4.1 All prices are stated in CHF and include the statutory value-added tax (VAT).
4.2 Payment is made exclusively via PayPal.
4.3 Full payment is a prerequisite for the commencement of the coaching.
4.4 Unused sessions are non-refundable.
5. Right of Withdrawal and Refunds
5.1 Under Swiss law, there is no statutory right of withdrawal for digitally booked services.
5.2 AVALES AG does not grant a voluntary right of cancellation or withdrawal.
5.3 Every booking is binding and cannot be canceled.
6. Rescheduling, Cancellations, and No-Shows
6.1 Coaching appointments can be rescheduled free of charge up to 24 hours before the appointment.
6.2 In the event of rescheduling or cancellation within 24 hours of the appointment, the session will be charged in full.
6.3 In the event of non-attendance (no-show), the session is also considered fully consumed.
6.4 Sessions within a package that are not attended expire without any right to a refund.
6.5 In the event of serious, unforeseeable events such as:
- medically certified illness,
- total technical failure on the part of the coach,
- platform disruptions (Teams/Zoom)
AVALES AG will endeavor to find a fair solution, but will not replace sessions that could not be carried out due to disruptions on the Customer’s side.
7. Validity of Coaching Packages
7.1 Coaching packages are valid for 12 months from the date of the first coaching session.
7.2 Sessions not used within this period expire and lose their validity.
8. Obligations of the Customer
8.1 Customers are responsible for:
- a stable internet connection,
- functioning hardware and software for video telephony,
- punctual attendance at agreed appointments.
8.2 Technical problems on the Customer’s side do not constitute grounds for a refund or rescheduling.
9. Liability
9.1 AVALES AG provides coaching services with a high level of professional competence and care.
9.2 Liability is limited to twice the price of the booked coaching package, except in cases of gross negligence or unlawful intent.
9.3 AVALES AG assumes no liability for:
- technical disruptions on the Customer’s side,
- internet or power outages,
- indirect or consequential damages,
- failure to achieve desired personal or professional results.
10. Confidentiality and Data Protection
10.1 AVALES AG treats all information received during coaching confidentially.
10.2 Video, audio, or screen recordings of coaching sessions are prohibited without explicit mutual consent.
10.3 The data protection notices of AVALES AG apply.
10.4 Documents, notes, and personal data will be deleted or destroyed after a maximum of 2 years.
11. Intellectual Property
11.1 All content, documents, and materials provided during the coaching are the intellectual property of AVALES AG.
11.2 Any transfer, duplication, or external use without written consent is prohibited.
12. Changes to the GTC
12.1 AVALES AG may adjust the GTC at any time.
12.2 For bookings already made, the version valid at the time of the order shall apply.
13. Jurisdiction and Applicable Law
13.1 Swiss law shall apply exclusively.
13.2 The place of jurisdiction is the registered office of AVALES AG, Hagenholzstrasse 56, 8050 Zurich, Switzerland.
